Justice delayed is Justice denied



Here comes yet another News..a desperate justice seeker sets himself on fire right in front of the Apex Court of the country.When moments later, shown on Live coverage on Tv channels , he shared his reason for self-immolation.Same old story, another victim of this painfully Slow Judicial system, belonging from Rajin pur..now just Imagine the misery of this poor soul...people familiar with the geographical distances of country can easily understand his plea.


A simple case of Family Court, brought him to Supreme Court.When I  was doing my Apprenticeship here in lahore, I had to visit Lahore High Court on daily basis,,there I saw these people, right on the verge of committing Self-immolation...their faces narrating their whole story.An old lady once told us that she is visiting the courts since last 15 years..her matter was a simple civil matter..a mere case of implementing a contract!


Then there was this man that I came acorss who appeared in court in place of his father, his father had died long ago, and he told us that after 20 years of his death, he had finally won the case.


 These are not the only stories, when I started writing this post, I did not want to write a typhical old story about the shortcomings of our systems, complaining about everything from economy to judiciary, No, I wont do that.I dont want to do that.


Still the sight of that man burning in  his own fire brought tears in my eyes..the man was in pain ,and there were those media people , all over him....surrounding him..asking him questions, pushing him for answers, ignoring his suffering, over-hearing a voice behind..."bhaie peechay ho jaein, ye bohat jul gya hai,issko hospital lay jana bohat zarori hai"..("please take a side, let us take him to the hospital, he has badly burnt himself")....but ofcourse they  were too busy to capture the precious moments out of their secret wish that might be the man doesnt survive and there they will play that footage with "EXCLUVIE" in Tonight's 9 O clock News Bulletin.what a golden chance to raise channel's rating...their bloody rating phobia and our bloody inclination towards "the sensational breaking news". we are so morally dead!!!


Now I am confused, dont know what exactly it was that made me write this piece..the misery of that justice-seeker or the cold selfish-ness of those men surrounding him with mics..you decide

There is no speedy justice anywhere in the world. “Justice delayed is justice denied” cannot be remedied without implementing "people friendly system under the light of the Noble Qur'an and Sunnah" gradually takes over in phases through amending the Constitution.---- Wishful thinking, of course!
    Nevertheless, I salute Justice Iftikhar Muhammad Choudhry CJPakistan, who has been doing a lot to overhaul our justice system despite the worst form of opposition from many quarters.
    Expectedly, the selfish elite went all the way to label the pious cleansing as mere judicial activism. Unfortunately, the apex judiciary has been mocked by the government through an ongoing stubborn defiance during a huge number of occasions/cases.
    In fact, many of us are self interested, and surely, selfishness leads to all corrupt ways to achieve goals.
    Genuinely speaking, educating the masses about what to believe and what to discard is the desperate needed way out - for socio-economic or political healing.
    In other words, what we need at the moment is a constructive “REVOLUTION” to make a positive change to cure the sick minds.

    If the suggested system is allowed to gradually take over in phases through amending the Constitution - only then there is a hope for faster justice.---- Wishful thinking, of course!

    no offense but I dont agree with you about Iftikhar ch.
    yes he is our hero..being a Lawyer..he is some body that I look up to...so does everybody else..look at the news channels...whereever there is injustice, everybody expects him to take sou-moto !! and he does that..most of the times...
    but tell me something..is it all that we should expect him to do? he is the cheif justice of pakistan..there are so many things he ought to do..,he needs to take those much awaited judicial reforms,,,,a common man wants justice as soon as possible....while engaging into a meaningless conflict with government is not going to solve any of these problems..he needs to take some solid steps...reform the judiciary....hire more judges...train them well....pay them well....there should not be so many law collegs..private law should not be allowed...there should be more courts...high court benches should be settled in the far off ares too..and the list is endless..when is he going to pay attention to these ?

    I dont object to what is he doing..he is doing a wonderful job,,but its not all he is supposed to do,..to standarize the judiciary should be his first and supreme priority....what do u think?

  4. very SAD..what kind of media and justice? shame in the name of democracy and rights......
    I mean where was the police and people when he was doin all that?
    I can see above lot of arguments ....
    But ...why would anybody burn himself?? is the burning or pain less then he was suffering?
    ....this is not solution to any problem...

  5. Yes Mishi, you do have a point that Mr. Ch needs to do more.
    However, there is a big BUT--- so Pl don't play ‘chachoo SAM’ with him via subjecting him to excessive pressure.
    “Do more” is kind of extremely tough demand under the current non cooperative environment created by the corrupt elite.
    In my opinion, Justice Choudhry is one the best judges with utmost integrity so far in the history of the rapidly failing country.
    So, he needs all kind of constitutional and moral support at the moment.
    Being CJP, he is more on the administrative side of the story constitutionally.
    Yes! You are 100% right about an excessive presence of unwanted law colleges throughout the country. They must immediately be closed as we need only quality and not quantity.
    Practising law used to be one of the best professions in Pakistan, but now the legal fraternity is crowded with non productive practitioners - who are hell bent to destroy the profession with corruption, incompetence and adulteration.
    Bottom line still remains that “nobody is perfect,” so please give your helping hand to the judiciary for speedy justice.
    Trust me - with your help, he could enhance the standard of justice system as he is too weak to bear the burden alone.

  9. He fought for justice,
    which was not there,
    finally,
    justice was showered upon him,
    by himself,
    match-stick replaced Pen and did the job, kerosene oil helped and .........
    was this final justice,
    he was waiting for,
    for years together ?

    COMMON MAN'S FAITH IS SHATTERED.

    I Hope this to never happen again, all those in power must ensure it.

  11. well...lawyers are equally responsible for this mess... they will go on strike for every issue...be it for offering the ghaibana janaza of osama to the transfer of a district court judge...and when they do appear in courts, they simply ask for change of date... im not saying that all lawyers are like this but more than 50% are like this and that is why the system is rotten :(

  13. well....its so common back in our country also, initially ppl don't understand n go into the court for small settlements which could have been settled otherwise on mutual understanding but no, they go to court and here it starts 'dates after dates' 'years after years'...finally a time comes when they curse themselves for coming into the court......and talking abt media ppl, well, they can go to extent for a bite to make it a breaking news.

  14. Justice delayed for so long makes no sense. It is pretty hopeless in India too. Justice = giving money to lawyers for no result. It is pretty hopeless situation.

    n thankyou for your comments...you are right, being a lawyer I know how it works in court tho I din practce much....but the lawyer part is defnlty respnsble for this chaos...I have seen lawyers avoiding the appearnce in court just to charge more ....they delibrtly make the proceeding linger on as much as they can...most of them!
